Terms of Service

These Terms of Service ("Terms") govern your use of the mobile game Snappy (the "Game") and the website at golovitsyn.com (the "Website"), both operated by Egor Golovitsyn ("I", "me", "my").

By installing, accessing, or using the Game or the Website, you agree to these Terms. If you do not agree, please do not use the Game or the Website.

1. Eligibility and age ranges

The Game is family-friendly and rated 4+ in the Apple App Store and Everyone in Google Play. People of any age may play.

On first launch, the Game asks you to pick your age range from three options: Under 13, 13–15, or 16 or older. The picker also runs again any time you tap Settings → Privacy choices → Manage consent. Your choice determines what data the Game and its partners may collect about you, as described in the Privacy Policy:

  • Under 13: only contextual (non-personalised) ads are shown, your advertising identifier is never collected, and analytics run in child-directed mode.
  • 13–15: in the EU and EEA, treated the same as Under 13 in accordance with Art. 8 GDPR. Outside the EU/EEA, can opt in to personalised ads.
  • 16 or older: full feature set, including the option to consent to personalised advertising and analytics.

If you are under the age of majority in your country, you must have a parent or legal guardian's permission to use the Game and to make any in-app purchases. The age picker is a self-declaration; please answer honestly so the Game applies the right protections.

2. Licence

I grant you a personal, non-exclusive, non-transferable, revocable, limited licence to download and play the Game on a compatible device that you own or control, for your own personal, non-commercial use.

This licence does not allow you to:

  • Copy, modify, distribute, sell, lease, or sublicence the Game.
  • Reverse-engineer, decompile, or attempt to extract the source code, except to the extent the law expressly allows.
  • Use cheats, automation, bots, mods, or any unauthorised third-party software to gain an unfair advantage.
  • Use the Game to violate any law or anyone else's rights.
  • Remove or alter any copyright notices or proprietary markings.

3. Your account and device

The Game does not require an account. Your progress is stored on your device. If you uninstall the Game, change device, or clear your device's data, your progress may be lost. I am not responsible for lost progress unless I caused the loss.

4. In-app purchases and virtual items

The Game offers optional in-app purchases (such as gems, gold, the "Remove Ads" upgrade, skins, and starter packs) processed through Apple's App Store or Google Play.

4.1 Billing

All purchases are billed by Apple or Google. Their terms and refund policies apply to the transaction. I do not receive or store your payment card details.

4.1a Parental authorisation for minors

If a player has declared an age under 13, or is otherwise a minor under their local law, in-app purchases require a parent or legal guardian's authorisation. Apple's Ask to Buy (Family Sharing) and Google's Family Link are the operating-system features that enforce this — please enable them on the child's device. I rely on these platform controls; I am not able to independently verify whether a particular purchase was authorised by a parent.

4.2 Virtual items have no real-world value

Gems, gold, skins, and other virtual items exist only inside the Game. They:

  • Have no monetary value and cannot be exchanged for real money.
  • Cannot be transferred outside the Game or to another player.
  • Are licensed, not sold — you do not own them.
  • May be modified, removed, or expired at my reasonable discretion (for example, if the Game is discontinued).

4.3 Right of withdrawal (EU consumers)

EU consumer law normally gives you a 14-day right of withdrawal for digital content. By starting to use a purchased digital item (e.g. spending gems, applying a skin, activating "Remove Ads") immediately after purchase, you expressly request immediate performance and acknowledge that you lose your right of withdrawal once that performance has begun. You confirm this by completing the purchase in the App Store / Google Play dialog.

4.4 Refunds

Refund requests are handled directly by Apple or Google. To request a refund, please use:

5. Advertising

The free version of the Game shows advertisements (including rewarded video ads). You can remove ads by purchasing the "Remove Ads" upgrade. Ads are served by third parties — I do not control their content.

The Game is configured as a Mixed Audience app: players who have declared an age below 13 (or below 16 in the EU/EEA) are placed in child-directed mode, which means only contextual (non-personalised) ads from COPPA-certified demand sources are shown, and no advertising identifier is shared. Players 16 or older can independently consent to personalised ads in the in-game GDPR dialog or in Settings → Privacy choices. See the Privacy Policy for full details.

6. User conduct

When using the Game, you agree not to:

  • Interfere with the Game's normal operation or servers used by it.
  • Attempt to gain unauthorised access to the Game, other users' devices, or related systems.
  • Exploit bugs to obtain virtual items or unfair advantages. I may remove items obtained this way.
  • Harass other users (where multiplayer features exist).

7. Intellectual property

The Game, its source code, art, music, characters, text, and all related content are owned by me or my licensors and are protected by copyright and other intellectual property laws. Nothing in these Terms transfers any ownership rights to you.

8. Updates and changes to the Game

I may release updates, change features, add or remove content, adjust balance and pricing, and modify or discontinue parts of the Game at any time. Where possible, important changes will be announced in advance.

9. Termination

You can stop using the Game at any time by uninstalling it. I may suspend or terminate your access to the Game if you materially breach these Terms (for example, by cheating or attempting to defraud the Game). Termination does not entitle you to a refund of past purchases unless required by law.

10. Disclaimer of warranties

The Game is provided "as is" and "as available", to the extent allowed by law. I do not guarantee that the Game will always be available, error-free, secure, or compatible with every device.

This clause does not limit your statutory consumer rights under German or EU law.

11. Limitation of liability

To the maximum extent permitted by applicable law:

  • I am liable without limitation for damages caused by intent or gross negligence, and for damage to life, body, or health.
  • For damages caused by simple negligence, I am only liable if an essential contractual obligation ("Kardinalpflicht") has been breached. In that case, liability is limited to typical, foreseeable damages.
  • Any further liability is excluded.
  • Liability under the German Product Liability Act (Produkthaftungsgesetz) remains unaffected.

12. Governing law and jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer with habitual residence in another EU country, you also enjoy the mandatory protections of that country's law.

Place of jurisdiction for disputes with merchants is my place of business in Germany.

13. EU online dispute resolution

The European Commission provides an online dispute resolution platform at ec.europa.eu/consumers/odr. I am neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

14. Severability

If any part of these Terms is found to be unenforceable, the remaining parts continue to apply.

15. Changes to these Terms

I may change these Terms from time to time. The "Last updated" date at the top tells you when the last change was made. Continued use of the Game after a change means you accept the new Terms.
